Chris Grayling: police will no longer use cautions for sexual offences against children, possession of an offensive weapon or supplying class-A drugs.

Serious offenders will no longer receive a mere "slap on the wrist", the justice secretary has said, as he announced an overhaul of the cautions system.

Chris Grayling said he was scrapping simple cautions, which do not involve any form of punishment, for serious crimes such as rape, manslaughter and robbery.

JA is finally getting some relief after 20 years of anxiety.

A, 50, is one of approximately 300 people whose names have been removed from Oklahoma’s Sex Offender Registry since a June state Supreme Court ruling, according to Department of Corrections records.

“It’s a big relief,” the Boynton man said. “I don't worry about it no more. I used to worry about it all the time — would I get in trouble where I lived.”

Nearly 7,400 convicted sex offenders’ names appear on the DOC’s registry. That is down from approximately 7,700 listed when the state’s highest civil court ruled amendments to the Sexual Offender Registration Act couldn’t be applied retroactively."

Nick Gargan wants officers to "think and speak differently"

"Chief Constable Nick Gargan is impatient for change and is not afraid of becoming unpopular in pursuit of it.

Just six months into his job, he is embarking on a crusade to transform the culture at Avon and Somerset Police.

His vision for a revised force includes a radical direct-entry scheme giving would-be chief inspectors the chance to skip promotion through the lower ranks.

But his proposal, just one of several ground-breaking reforms he has planned, has already riled some.

The Police Federation called it a "half-baked idea", claiming "people who have not seen a dead body" would not earn the respect of colleagues.

LANSING (AP) -- More people will be added to Michigan's public sex offender registry under a bill signed by Gov. Rick Snyder.

The bill signed Tuesday will require people convicted of a single Tier I offense for some crimes involving minors to be placed on the online registry. Offenses that qualify include possessing child pornography and surveillance of a minor.

Republican Sen. Rick Jones is the bill's sponsor. He says it will add about 250 people to the public registry.

Arkansas officials defend law barring Medicaid funds to registered sex offenders

"Arkansas officials are defending in court a state law that prohibits Medicaid funds from going toward registered sex offenders, saying the prohibition serves a legitimate public interest.

Attorneys for the state Department of Human Services on Wednesday asked a federal judge to reject a doctor's effort to block enforcement of the law while he challenges its constitutionality. A hearing is scheduled Thursday on the request.

The law is being challenged by Dr. Lonnie Joseph Parker, who was convicted in 2000 of possessing child pornography. Parker has long maintained his innocence and had his medical license reinstated in 2005.

DHS attorneys said the law doesn't prevent Parker from practicing medicine in the state and said the restriction fits in with the state's goal of protecting the public from sex offenders.",0,4763505.story

"Plaintiffs' affidavits explain in detail the difficulties and embarrassment they and their families have endured as a consequence of complying with these new restrictions, even though their convictions are now almost twenty years in the past and they have led completely law-abiding, if not exemplary, lives in the interim. Their stories raise substantial questions as to the wisdom and fairness of subjecting them and similarly situated individuals to lifetime registration and notification requirements with their attendant obligations and restrictions. But given the previous decisions addressing the issues Plaintiffs raise, I conclude that the relief, if any, must come from the legislative branch. With one limited exception, the fact that the restrictions are difficult and cumbersome is not enough to make them unconstitutional. For the most part, the amendments to the Wisconsin sex offender registry system do not depart in any meaningful way from the systems already found to be constitutional by the Bollig and Smith Courts.

The lone exception I find to this is the $100 fine provision, which I have concluded cannot be constitutionally imposed on them. With this exception, Defendants' motion for summary judgment is GRANTED and Plaintiffs' motion for summary judgment is DENIED. The Clerk is directed to enter judgment declaring that imposition of the $100 annual fee on Plaintiffs pursuant to Wis. Stat. § 301.45(10) constitutes punishment in violation of their rights under the ex post facto clauses of the United States and Wisconsin constitutions and enjoining Defendants from assessing or collecting such amount from Plaintiffs. All other claims against Defendants are dismissed with prejudice."

Halloween Sex Offenders Policies Questioned


The rates of non-familial sex crimes against children under the age of 12 are no higher during the Halloween season than at any other times of the year, according to a study published in the September issue of Sexual Abuse: A Journal of Research and Treatment (published by SAGE). The findings raise questions about the wisdom of law enforcement practices aimed at dealing with a problem that does not appear to exist.

Using the National Incident-Base Reporting System, the study looked at more than 67,000 non-family sex offenses reported to law enforcement in 30 states across nine years. Taking into account such variables as time, seasonality and weekday periodicity, the researchers found no increased rate of sexual abuse during the Halloween season. Additionally, the number of reported incidences didn’t vary before or after police procedures were implemented to prevent such abuse.

“We do not suggest that there is no risk on Halloween or that parents should abandon caution and supervision of their children,” write the authors in the article. “But there does not appear to be a need for alarm concerning sexual abuse on these particular days. In short, Halloween appears to be just another autumn day where rates of sex crimes against children are concerned.”

Research has found that the highest danger for children during the Halloween season was from pedestrian- motor vehicle accidents, not from sexual abuse by strangers.

“It is important for policy makers to consider allocation of resources in light of the actual increased risks that exist in areas besides Halloween sex offender policies,” the authors conclude. “Our findings indicated that sex crimes against children by nonfamily members account for 2 out of every 1,000 Halloween crimes, calling into question the justification for diverting law enforcement resources away from more prevalent public safety concerns.” “How Safe Are Trick-or-Treaters?: An Analysis of Child Sex Crime Rates on Halloween” in Sexual Abuse: A Journal of Research and Treatment was written by Mark Chaffin, University of Oklahoma Health Sciences Center;Jill Levenson, Lynn University;Elizabeth Letourneau, Medical University of South Carolina Family Services Research Center; and Paul Stern, Snohomish County Prosecutors Office.

"In North Carolina, a sheriff tells parents to check the online sex offender registry before allowing children to trick-or-treat. In Montana, a town offers a "trunk-or-treat" event where kids can get Halloween candy from trunks of cars in a parking lot to avoid potential danger. In New York, "Operation Halloween: Zero Tolerance" prohibits sex offenders from wearing masks or costumes or answering their doors on Halloween, and, as a parole source says, "There is certainly nothing more frightening than the thought of one of these men opening their door to innocent children."

In Oklahoma, a city council is considering an ordinance forbidding sex offenders from decorating their homes or passing out candy on Halloween. In Orange, California, sex offenders can't answer their door or have outside lighting on Halloween, but an additional ordinance requiring window signs saying, "No candy or treats at this residence" was recently revoked after attorneys argued it was a form of cruel and unusual punishment."

Police commissioner pledges to crack down on online abuse in wake of [BS] paedophile [sic] report

"BOLTON’S police and crime commissioner is urging parents and agencies to work harder to protect children online.

It follows a report from the Child Exploitation and Online Protection Centre (Ceop), which found that paedophiles are using blackmail to force hundreds of young people to perform sexual acts online, turning them into little more than sex slaves.

Ceop also revealed that seven children targeted by abusers in this way had killed themselves.

Tony Lloyd is now seeking a meeting with Ceop bosses to see what practical steps can be taken to protect our young people.

He said: “This report is shocking [if only it were all true]. The idea that children are being driven to suicide because they are being taken advantage of online should send a chill down our spines. But it’s also welcome that Ceop is highlighting the issue [as it is all so 'secret' and all]."

A 16-year-old Victoria girl has been charged with distributing child pornography for sending a picture of another girl by text message on her phone.

The trial of a Victoria-area teen who is facing child pornography charges for allegedly texting a nude picture of another girl without her consent will go ahead before a constitutional challenge, a judge has ruled.

The 16-year-old Saanich girl is facing charges of possession and distribution of child pornography and uttering threats after she allegedly distributed nude pictures of her boyfriend's ex-girlfriend.

Today, a provincial court judge ruled the trial will go ahead this fall, before a related constitutional challenge to the child pornography law will be heard.

The teen's lawyer Christopher Mackie says they are launching a constitutional challenge against Canada's child pornography laws as they apply to people under age, claiming the charges amount to age discrimination."

Sex offender registry: Find better way for offenders

"It’s rare to find a progressive trend in our Republican-dominated legislature, but their recent effort (House Bill 301) to downsize Missouri’s “sex offender registry” is laudable, even as Gov. Jay Nixon’s veto is perplexing.

Registering “sex offenders” (far too broadly defined) is based on the questionable idea that they are more likely to offend once released — even though a U.S. Department of Justice study of criminal recidivism rates showed many convicted of sex-related offenses had lower rates of re-arrest compared to other criminals.

We don’t require armed robbers or other felons to register on a public list; rather they serve their sentences and (hopefully) re-integrate into society. And that is the main problem with registering “sex offenders.” Branding all of them for life can only make it more difficult to become normal members of society upon release.

Indeed, being publicly labeled a “sex offender” could conceivably spur some to live up to the heinous title hung forever around their necks.

While a certain percentage of criminals will re-offend, we need to take a hard look at the utility of the “sex offender registry” experiment.

Even though Nixon’s veto of this attempt to downsize the list was not overridden, the legislature, the voters and Nixon should continue to look for better ways of encouraging those who made big mistakes to start a new and better life after prison.

Perpetual, public shaming is not one of them."

Compulsive pornography users shows the same brain activity as alcoholics and drug addicts

"Self-styled vigilantes attacked the home of a hospital paediatrician after apparently confusing her professional title with the word "paedophile", it emerged yesterday.

Dr Yvette Cloete, a specialist registrar in paediatric medicine at the Royal Gwent hospital in Newport, was forced to flee her house after vandals daubed it with graffiti in the middle of the night. The word "paedo" was written across the front porch and door of the house she shared with her brother in the village of St Brides, south Wales.

Dr Cloete, 42, confirmed she had left the property after the "distressing" attack. "For the time being I have moved out of the area because when something like this happens you just cannot feel safe in your own home. "We removed the graffiti within hours, but what happened was terrible and it has been extremely distressing."

"... a female paediatrician consultant called Yvette Cloete was indeed labelled a "paedo" after a campaign by the News of the World to name and shame paedophiles in the community.

The incident took place in Newport, Gwent, not in Portsmouth (where there had been anti-paedophile protests after eight-year-old Sarah Payne was murdered).

Dr Cloete returned from work at the Royal Gwent Hospital to find "paedo" spray-painted on her front door. Local police believe the graffiti was written by someone who confused her job title with the word paedophile.

It was no doubt a very distressing incident for Ms Cloete, who decided to move home shortly afterwards. But there is no evidence that a mob was involved or of any threats or incidents of physical pressure or violence."

Plan to satellite track sex offenders in Scotland

"The plans, which have received backing across the political spectrum, would see dangerous criminals [sic] tracked by satellite.

SATELLITE technology would be used to track sex offenders under Scottish Government plans to crack down on the most predatory and dangerous criminals [why are they not in prison, then, Kenny?].

A consultation launched tomorrow will also propose using the GPS tags to track domestic abuse and persistent offenders, and alcohol bracelets for people who commit crimes while drunk.

While many sex offenders, and other criminals, are already tagged, the move would see a major increase in how much of their movement is monitored.

Current radio frequency tags go off if someone leaves a certain area, such as their home, or goes somewhere they should not go within set times.

Using satellite technology and Google maps, police will be able to monitor a sex offender at all times, wherever they go. They will be able to observe patterns of movement to help build intelligence.

Writing in today’s Scotland on Sunday, justice secretary Kenny MacAskill said: “Satellite tracking can enable authorities to pinpoint an offender’s [ex-offender, Kenny, a 'free' person], that is exact location in real time, which has the potential to greatly assist how they are monitored. It also allows them to set up specific exclusion zones, preventing offenders [ex-offender, Kenny, a 'free' person] from entering potential risk [either there is a risk, or there is not - that is what 'risk' means] areas like high streets [!], schools and playgrounds. Ex-solicitor general Vera Baird banned from driving

"Vera Baird Vera Baird represented Redcar from 2001 to May 2010.

The former solicitor general Vera Baird has been banned from driving for six months after travelling at nearly 100mph along the M4 motorway.

Magistrates in Pontypridd rejected the QC's arguments to keep her licence. She claimed it would cause her hardship winding up her parliamentary affairs.

Former MP Baird, of Crouch End, London, lost her Redcar seat in May's election.

She was given five penalty points, which added to those already on her licence gave her an automatic ban.

She was also fined £400.

Baird, 60, had previously been found guilty in her absence but the case was reopened when she explained she had never received a summons."

Speeding drivers targeted

"Speeding and inconsiderate drivers are being targeted in a crackdown on anti-social behaviour in the Alnwick area.

Officers have been working with community volunteers on a Speedwatch scheme as well as visiting local schools to reinforce safety messages to the drivers of the future.

The crackdown has the backing of the Northumbria Police and Crime Commissioner Vera Baird, who is encouraging anyone concerned about anti-social behaviour to get in touch so action can be taken.

Neighbourhood Inspector Paul Truscott said: “Residents and local councillors at public forums have raised the issue of motorists driving at speed on rural roads causing a danger."
